General terms and conditions of business
§1 Subject of the terms and conditions
The following paragraphs define the general terms and conditions of business with regard to participants in the European Podcast Award and users of the platform for the European Podcast Award under www.european-podcast-award.eu.
The participation in the European Podcast Award is free of charge. No fees or other expenses will be incurred.
§3 Confirmation of the general terms and conditions of business
All participants in the European Podcast Award automatically confirm the general terms and conditions of business defined here.
§4 Data and utilisation thereof
All personal data that has been submitted voluntarily for the participation or the appraisal of podcasts in the course of the European Podcast Award will not be passed on to third parties and will only be used internally. On request, the European Podcast Award will provide information concerning news of the award at different intervals of time, as well as news relating to offers of its partners and sponsors. The data protection rules of the European Podcast Award shall apply.
§5 Terms and conditions of participation
Producers or listeners of podcasts can submit as many proposals as they wish, but this must be online via the portal of the European Podcast Award. All particulars and information concerning the podcast will be listed on the Submit Podcast page. The Award editorial department will examine the entries and then activate the podcast online to be rated and evaluated. This will follow as quickly as possible. There is no legal claim that the proposal shall be published in the portal of the European Podcast Award. The editorial department shall reserve the right to refuse participation due to reasons as regards contents or legality.
Every participant in the Award pledges to indemnify the European Podcast Award from any kind of liability and from all obligations, expenses and claims with regard to damages resulting from defamatory statements, insults, infringement of personal rights, due to the cancellation of services for participants, due to the violation of intangible goods or other miscellaneous rights.
§ 7 Severability clause
Should an individual provision or several of these provisions be ineffective or become invalid, this shall not affect the validity of the remaining provisions. The invalid provision shall be replaced by an effective ruling, which is as close as possible to the invalid provision in the economic purpose.
